I've run into it before, and generally I tell them if it's a paid-for theme then they need to go to whomever they paid. I do the same for Genesis and Hybrid, though. I mean, those are pay-support themes, and I'd like to see the devs getting by.
If you stole a theme, we shouldn't help you. If you BOUGHT a theme, you should talk to the people you bought it from. If you bought a theme from a third party and just got screwed... Tough titties, as my grandmother says. I don't know any non-GPL themes that are free, now that I think on it, so that covers everything for me.
