Also, if that's true, why does the validator use an SGML parser for  
HTML? View the source of it, and you'll see it does.

Lastly, as HTML is treated in the real world (which isn't SGML) <p/>  
is an opening tag (the solidus creates a parse error as an invalid  
attribute), which is not closed till the next </p> (or implied </p>).
