 Use Thickbox and within call the media insert.

 In a default theme there is no modal thickbox wrapper around the media
 popup window.

 It happens when you use thickbox tb_window and within thickbox you call
 the media insert screen.

 Btw It does not happen when you select another color scheme for the user.
 It only happens in the default color scheme.

 Does that set you in the correct direction?
