Comment:

 As a project, WordPress will be taking the advice of our own legal
 advisors.

 The changes in [56074] use sessionStorage which is discarded each time a
 user closes their browser. The data is not persistent. The date check is
 to ensure long running sessions do not miss WP updates.

 Discussion can continue on a closed ticket, but as I said, WordPress will
 be following the advice of our own legal advisors.
