Haven't read the whole thing yet, but just wanted to comment on the Settings
API issue:

The Settings API is rather immature currently. Not even WordPress itself
(version 3.2 at the moment) uses it for every option. For reference:

I guess there should be more communication between the theme reviewers and
the core team.
