Can you please cite something? The validator marks this as valid as
it is a null end tag (so <p/> is equivalent to <p>/</p>). The SGML
declaration of HTML[1] and SGML[2] make this plainly clear. The SGML
declaration would need NESTC "/" and NET ">" to allow the behaviour
you are describing.
