[wp-testers] "embed" and standards

"WordPress strives to conform to the XHTML 1.0 Transitional standard."

The "insert/edit embedded media" function in the visual editor
of WP2.5 however uses the "embed" element that does not exist
in any version of XHTML (nor in any version on HTML).

Is this a deliberate choice not to conform to the the XHTML 1.0
Transitional standard, or is it a mistake?

I haven't tested this very much, but some people claim
that it possible to embed flash media using only the
"object" element in a standards conformant way. It that
is true, then there seems to be no reason for WP to use the
non-standard "embed" element.

Any thoughts on this?
